Partners Elected as Coordinators of ABPI Study Committees

We are pleased to share that our partners, Philippe Bhering and José Roberto de Almeida Junior, have been invited to continue as coordinators of their respective Study Committees at the Brazilian Intellectual Property Association (ABPI) for the upcoming cycle.

Philippe Bhering will continue as Coordinator of the International Intellectual Property Law Committee, which focuses on monitoring and studying international legal frameworks, analyzing their potential impact on Brazilian legislation, and examining the intersection of international law with geopolitical issues related to Intellectual Property. The Committee is also open to international cooperation in the field of IP.

José Roberto de Almeida Junior will remain as Coordinator of the Copyright and Personality Rights Committee, focusing on studying and discussing legal and regulatory issues related to copyright, related rights, and personality rights, including image, name, voice, and privacy. This Committee addresses the protection, limits, enforcement, and contractual aspects of these rights under Brazilian legislation, promoting technical debates and the development of best practices within the intellectual property community.

The new regulation brings greater legal certainty and directly impacts trademark registration and protection strategies in Brazil, especially for signs that, although originally weak or descriptive, have acquired distinctiveness through use.

Philippe Bhering and Chairin Kong Discuss Colgate’s Recognition as a Famous Trademark in Veja Negócios

Colgate has achieved the prestigious “highly renowned” status in Brazil, granted by the Brazilian Patent and Trademark Office (INPI). This recognition places Colgate among the 193 brands in Brazil that hold this distinction, a testament to the exceptional distinctiveness of the brand and its widespread public recognition.

Philippe Bhering and Chairin Kong successfully led the proceedings for Colgate’s recognition. As Philippe Bhering explains in an interview with Veja Negócios, “the ‘highly renowned’ status confirms that the trademark possesses exceptional distinctiveness and broad recognition among Brazilian consumers, associating it with prestige, tradition, and quality. This status offers special protection across all market segments, as established by Law No. 9.279/96 (Industrial Property Law).”

To obtain this status, companies must submit a petition to the BPTO, demonstrating compliance with the requirements set out in Ordinance No. 08/2002, which was updated earlier this year after a public consultation.

Anti-Counterfeiting and Anti-Piracy Department participates in the Trade Dress operation in the Federal District.

December 3rd is National Anti-Piracy and Biopiracy Day, established by Law No. 11.203, of December 1, 2005.

This date serves as an important opportunity to raise awareness about the negative impacts of counterfeit goods, which range from economic losses and serious health and safety risks to consumers, to significant harm to the environment.

In recognition of this day, we highlight one of our recent anti-piracy actions, conducted in partnership with agents from the Division for the Repression of Intellectual Property Crimes (DRCPIM) of the Federal District, the Special Operations Division, and the Federal District Health Surveillance. Together, we participated in a large-scale seizure operation in the Ceilândia region of the Federal District, Brazil’s capital.

The “Trade Dress” operation took place in a warehouse and two stores, resulting in the seizure of 40,000 counterfeit products, including perfumes and cosmetics being sold as originals.

Our Anti-Counterfeiting Department works closely with the responsible authorities to strengthen control measures against counterfeit goods, supporting safer markets, fair competition, and the protection of brand owners and consumers.
