New BPTO Fee Schedule: What Changes from August 7, 2025, and How to Prepare
The BPTO has published its new Fee Schedule, which will come into force as of August 7, 2025. In addition to an average increase of 24% in fees, the update introduces significant changes to the fee structure, creates new services, revises nomenclature, and incorporates important procedural innovations in trademark, patent, and industrial design matters.
Among the main changes, the BPTO has redesigned the trademark fee system. Between August 7 and September 19, trademark filing and the first ten-year registration term will continue to be paid separately, albeit at the updated rates. As of September 20, however, both stages will be consolidated into a single payment at the time of filing, with fees set at R$ 880 for applications with pre-approved specifications and R$ 1,720 for applications with free specifications.
Another key innovation is the introduction of a simplified opposition procedure in trademark matters, aimed at streamlining examination. This new model will take effect on December 20, 2025, and will be filed through an electronic form. The opposition will be limited to item XIX of article 124 of the Brazilian Industrial Property Law, allowing a maximum of five prior art references per class, without attachments or argumentative text.
The new fee schedule also formally allows for the submission of proof of secondary meaning, enabling applicants to demonstrate that a trademark has acquired distinctiveness over time. This proof may be submitted at the time of filing, within 60 days after publication, in an appeal, or in responses to oppositions or annulment requests, subject to a fee of R$ 4,700 per request.
In terms of costs, the update reflects an overall average adjustment of 24%, with notable increases in several trademark, patent, and industrial design fees. For trademarks, opposition fees increased from R$ 355 to R$ 520, and appeals against refusal rose from R$ 475 to R$ 700, while response fees were reduced from R$ 280 to R$ 180, and ordinary extensions decreased slightly. Patent fees also saw substantial increases, including filing, examination requests, and annuities. Industrial design fees were similarly adjusted, affecting both filing and quinquennial payments.
According to the BPTO, these changes are intended to ensure the Institute’s economic sustainability while modernizing services to meet growing demand. Bhering Advogados Participates in ABPI Scientific Meeting
From June 2 to 6, 2025, the Associação Brasileira da Propriedade Intelectual (ABPI) will hold the fourth Scientific Meeting of its Study Committees. Each of ABPI’s 18 Study Committees will organize a panel focused on specific and up-to-date intellectual property topics.
Partner Philippe Bhering serves as Coordinator of the International Law Study Committee. This year, the committee will organize a panel to explore practical and current issues related to patent protection and litigation under the new European patent system, more than two years after its implementation.
The event will be held online on June 6, 2025, at 11:00 a.m. Registration for the ABPI Study Committees’ Scientific Meeting can be completed through the ABPI platform.
Bhering Advogados Participates in the Joint Parliamentary Front in the Federal District
Last year, the Joint Parliamentary Front in Defense of Intellectual Property and Combating Piracy was launched in Brasília. The Front is chaired by Júlio Lopes and brings together members of the Câmara dos Deputados and the Senado Federal.
The Front’s objective is to improve legislation and public policies to strengthen the protection of intellectual property in Brazil. In this context, it seeks to promote dialogue among Parliament, the productive sector, academia, and civil society, encouraging initiatives that foster innovation, economic competitiveness, and contribute to Brazil’s economic and social development.
Last month, the Joint Parliamentary Front presented its Legislative Agenda in Brasília, which includes support for several bills currently under consideration in the National Congress. These include the bill addressing provisional patent application (Bill No. 2,210/2022); the bill proposing harsher penalties for trademark counterfeiting crimes (Bill No. 3,375/2024); the bill granting financial autonomy to the Instituto Nacional da Propriedade Industrial (INPI) (Supplementary Bill No. 143/2019); and the bill aimed at modernizing the patent system (Bill No. 2,056/2022).
Partner Philippe Bhering participated in both events and had the opportunity to engage with several authorities, including Congressman Júlio Lopes, Chair of the Front, to discuss the ongoing legislative agenda.

Bhering Advogados strengthens its Patent Litigation team
The Anti-Counterfeiting and Piracy Department takes part in an operation in Guarulhos (SP)
Bhering Advogados recently participated in a large-scale seizure operation in Guarulhos, São Paulo, in collaboration with officers from the 1st Police Precinct for Intellectual Property Investigations of the Criminal Investigations Department of the State of São Paulo.
The operation resulted in the shutdown of a counterfeit toy factory, which also lacked the required regulatory certification seals, posing a risk to children’s health and safety. More than 90,000 products were seized, including 56,000 units ready to enter the market.
Our Anti-Counterfeiting Department works closely with the authorities to strengthen enforcement measures in the fight against counterfeit products.

Bhering Advogados is hosting an Anti-Counterfeiting Training for Customs Office in Fortaleza
On March 27th, Bhering Advogados organized an Anti-Counterfeiting Training Session for agents of the Interior Policing Battalion of the Military Police of Ceará (responsible for monitoring state highways), the National Land Transport Agency, the National Telecommunications Agency, the Finance Department of the State of Ceará and the Smuggling and Embezzlement Repression Division of the 3rd Tax Region, in Fortaleza, in the state of Ceará. The training focused on techniques for identifying counterfeit products, mainly from the automotive, toy and entertainment segments, enhancing the ability of customs agents to inspect goods destinated for or in transit through Brazil.
More than 50 agents took part in the training, which lasted all day and was conducted by the firm’s criminal law specialist, Lucas Castro.
This training is part of the ongoing efforts by our Anti-Counterfeiting department to strengthen control measures against the import of counterfeit products.
Bhering Advogados Anti-Counterfeiting Department attends large-scale seizure operation in 3 Brazilian states
At the end of January 2025, Bhering Advogados, in collaboration with agents from the Federal Revenue Service, participated in three search and seizure operations across the Brazilian states of Ceará, Rio de Janeiro, and Rio Grande do Sul.
On January 30, in the city of Porto Alegre, in the state of Rio Grande do Sul, approximately 25,000 products were seized, including t-shirts, shoes, accessories and perfumes, with an estimated value of R$1.5 million. For more information (in Portuguese), please visit.
On January 31, in the city of Duque de Caxias, in the state of Rio de Janeiro, an operation at a company and warehouse resulted in the seizure of hundreds of counterfeit products, including backpacks, lunchboxes and cases. For more information (in Portuguese), visit.
Also on January 31, a raid was conducted at 5 wholesale stores in the central region of the city of Fortaleza, in the state of Ceará, resulting in the seizure of thousands of counterfeit products, including backpacks, toys, and electronics.
Our Anti-Counterfeiting department works closely with government agents to strengthen enforcement measures and combat the trade of counterfeit products.

On October 17th, Bhering Advogados organized an Anti-Counterfeiting Training Session for Federal Revenue Service officers at the Port of Santos, São Paulo. The training focused on techniques for identifying counterfeit products across different industries, enhancing the ability of customs agents to inspect goods destinated for or in transit through Brasil. The session was conducted by the firm’s criminal law specialist, Lucas Castro.
This training is part of the ongoing efforts by our Anti-Counterfeiting department to strengthen control measures against the import of counterfeit products.
