BPTO opens public consultation on expedited examination for industrial designs
The BPTO recently published Public Consultation No. 2/2026, concerning the creation of rules for expedited examination for industrial designs in Brazil.
The consultation will remain open for 45 days from its publication in Official Gazette No. 169. During this period, interested parties may submit comments and suggestions on the draft regulations and guidelines prepared by the BPTO.
What is under consultation?
The proposals submitted for public review address:
- A regulation establishing expedited examination for industrial designs before the BPTO;
- The modalities of the pilot project for expedited examination;
- The quota system and criteria for accepting requests during Phase I of the pilot project; and
- Guidelines on expedited examination for industrial designs, to be incorporated into the Industrial Design Manual.
The draft documents are available in full on the BPTO website and on the Brazil Participatory Platform.
How to participate:
Comments must be submitted through the specific form made available on the BPTO website and the Brazil Participatory Platform.
Submissions must:
- Be entered in the field corresponding to the relevant article or item of the draft;
- Specifically address the subject matter of the provision being commented on; and
- Comply with the deadline and requirements established by Public Consultation No. 2/2026.
Note: Late submissions, submissions made through other channels or comments that do not comply with the consultation rules will not be considered.
Next steps
After the consultation period closes, the BPTO will analyze and consolidate the comments received. The Office will then respond to the contributions and publish the final versions of the regulations and guidelines concerning expedited examination for industrial designs.
The initiative may be relevant for applicants and rights holders seeking greater speed in protecting visual creations applied to products, particularly in industries where time to market and product differentiation are strategically important.
