Geographical Indications
Geographical indications are distinctive signs used on goods that have a specific geographical origin and possess qualities, characteristics, or a reputation attributable to that origin. Many geographical indications have acquired significant recognition among consumers and, if not adequately protected, may be misused in unfair commercial practices.
Their recognition under international treaties has resulted in specific protection mechanisms within Brazilian Industrial Property Law and related legal frameworks, including unfair competition, consumer protection, and product certification regulations. Fundamentally, the use of a geographical indication is restricted to producers located in the designated region who comply with established technical standards. Any unauthorized use capable of misleading consumers as to the true origin of the product is prohibited and subject to sanctions ranging from injunctive relief to fines and damages.
Our team possesses comprehensive knowledge of the procedures for obtaining recognition of geographical indications, whether in the form of an indication of source or a denomination of origin. At the preliminary stage, we conduct meetings with cooperatives and producer associations to clarify and assess whether the legal requirements for recognition are met. Based on these discussions, we issue a legal opinion addressing the feasibility of filing an application and provide guidance on the preparation of supporting evidence and required documentation.
At the administrative level, our assistance includes the preparation and filing of the recognition application and monitoring of the proceedings before the Brazilian Patent and Trademark Office (INPI) until registration is granted.
