For example, we assess the distinctiveness of a proposed trademark in relation to prior marks in order to guide clients on risk exposure and potential strategies to reduce protection and enforcement costs.
Our extensive experience also encompasses legal advisory services on commercial matters related to trademark protection, including promotional use, the likelihood of confusion arising from packaging and trade dress, and trademark use in consumer relations. We also evaluate alternative avenues for protecting distinctive signs, including copyright protection, unfair competition claims, and advertising self-regulation mechanisms (CONAR), among others.
We manage thousands of trademark registrations and applications filed in Brazil and abroad on behalf of clients of diverse origins and industries.
Through our established trademark watching service, we regularly monitor the publications of the Brazilian Industrial Property Gazette (Revista da Propriedade Industrial – RPI) issued by the Brazilian Patent and Trademark Office (INPI). This enables us to notify clients of potentially conflicting trademark applications and, when authorized, to take the appropriate measures to prevent their registration.
Depending on client needs, we also monitor broader media channels to identify unauthorized trademark use, as well as trademark application filings in other jurisdictions.
