Brazil’s AI Agenda: Advancing Towards Regulation

The Brazilian Senate has taken a significant step towards regulating Artificial Intelligence (AI) by presenting a preliminary report that consolidates ten bills on the matter into a single legislative proposal. This development marks a crucial step in addressing the ethical, legal, and societal implications of AI technology.

The new legislative proposal outlines several key points aimed at regulating AI. One of the notable aspects is its focus on ensuring accountability and transparency in AI systems. It aims to establish mechanisms for auditing and certifying AI technologies, promoting trust among users and stakeholders. Additionally, the proposal addresses concerns regarding data privacy and security, establishing measures to safeguard individuals’ rights.

Furthermore, the proposal emphasizes the importance of promoting innovation and competitiveness in the AI sector. It seeks to foster a supportive environment to research and development while ensuring compliance with ethical standards and societal values. This dual approach aims to harness the potential of AI while mitigating its potential risks and challenges.

It also proposes significant penalties in case of violations, such as fines of up to BRL 50 million. Such penalties are to be imposed by a specific agency to be created to oversee AI regulation, with coordination appointed by the government, similar to existing federal regulatory agencies.

The preliminary report will now be discussed with the society, the industry, and sectors of the government. Once a final version is achieved, it will be voted by the Senate. Rapporteur Eduardo Gomes expects to have it enacted until the G20 meeting, in November.
