The Appellate Court of São Paulo upheld the first instance decision in a lawsuit filed by Porsche against two infringers who were producing and selling full-size replicas of Porsche’s vehicles in Brazil, including motorized ones, as well as car seats and other items bearing Porsche’s registered trademarks.

The judge recognized the violation of Porsche’s registered trademarks and industrial design, and also the practice of acts of unfair competition by the infringers. In this sense, the judge confirmed its preliminary injunction decision and ordered the infringers to refrain from producing and selling replicas of any Porsche’s vehicles and from using Porsche’s registered trademarks without authorization, in addition to paying Porsche material and moral damages.
