Clarisse de la Cerda, partner at Bhering Advogados, was interviewed by Jornal Hoje to explain that organizations that misuse personal data will now face the penalties of the Brazilian Data Protection Law (LGPD).

Although the LGPD was sanctioned in 2018, organizations had two years to adapt their operations and structure to the new law before the Data Protection National Authority could start applying penalties, including fines, for non-compliance.

Clarisse states that the Data Protection National Authority will actively monitor how organizations are processing personal data and will also receive complaints from data subjects who had their personal data processed for different purposes than the ones authorized by law and informed by the organization. Ms. De La Cerda also emphasizes that there are different ways to seek damage repair.
