Starting September 1, patent applications that fit in the modalities “technology made available in the market” or “technology resulting from public funding” will have their examination proceedings accelerated.

For the purposes of the project at issue, “technology made available in the market” consists in the process in which the matter object of the claims, in whole or in part, were licensed, put for sale, imported or exported, having the Brazilian market as reference. In turn, the modality “technology resulting from public funding” refers to the processes in which the claims are a direct result from public funding, expressly allocated for the development of the technology object of the patent application.
