In response to the Direct Action of Unconstitutionality filed by the Federal Council of the Brazilian Bar Association (CFOAB), Justice Rosa Weber granted an injunction suspending the effectiveness of Provisional Measure 954/2020, published on April 17, 2020. Said normative act had allowed the Brazilian Institute of Geography and Statistics (IBGE) to access personal data of users of fixed line and mobile telephone operators with the purpose of producing statistical data during the current scenario of the new coronavirus pandemic.

The approval of the injunctive relief, according to the Judge, is justified to “prevent irreparable damage to the privacy and confidentiality of the private life of more than one hundred million users of fixed and mobile telephony services (…)”. The decision takes immediate effect but must be later endorsed by the Plenary of the Supreme Federal Court.
