The article analyses the role of procedural formalism in the context of the new Brazilian Code of Civil Procedure, in view of the contemporary concept of due process, related to the notion of procedural adequacy to the demands and specificities of the litigious right pursued by the parties, and of a procedural model based on cooperation.
