News | Brazil to launch arbitration in domain name disputes

The use of arbitration in disputes involving domain names in Brazil is expected to begin this year. TheBrazilian Internet Steering Committee (CGI.br) is about to introduce a provision for the use of alternative methods of resolving disputes on “.br” domain names. The provision will be included in the registration agreement. The use of arbitration will be gradually introduced in Brazil. The first test will be done with top level domain names “.net.”
The possibility of using alternative resolutions for disputes over domain names is an old demand. Since Brazil has not followed ICANN’s Uniform Domain-Name Dispute-Resolution Policy (UDRP), judicial proceedings are the only available option against trademark violation through domain names.
