News | TJ-RS condemns trademark misuse

The 9th Civil Chamber of the Court of Appeals for the State of Rio Grande do Sul condemned Indústria de Produtos de Limpeza Cloris Ltda for trademark infringement on the adoption of a sign that was similar to a competitor’s mark. The Court found that the similarity between the marks “Clorisol” and “Clorosul”, owned by Plaintiff, and “Clorisul” was likely to confuse consumers, inducing error.
The Court also confirmed that Defendant was prohibited to use mark “Clorisol”. In addition to not being able to use those marks, Defendant will have to pay compensation for moral damages amounting to twenty-thousand Brazilian Reais, and a fine of thirty-thousand Brazilian Reais for breach of observation.
