Partner Clarisse de La Cerda contributed with comments to Valor Econômico Newspaper’s report regarding the first penalty imposed by the Brazilian Data Protection Agency for a violation of the Brazilian General Data Protection Law.

According to Clarisse de La Cerda the fine, despite appearing to be of low value, has a significant impact on the punished party, which is an individual microentrepreneur with an estimated employee count ranging from 1 to 10.

This first instance decision can now be appealed to the Board of Directors, composed of five directors of the Federal Agency. If upheld, the decision in the second instance can still be challenged before a Federal Court.
