The article “Procedural law and economic analysis: a study on private incentives for litigation and the system of binding precedents”, authored by Isabel Milman, was published in the book “Themes of Economic Analysis of Procedural Law” by Editora GZ.

The article analyzes Brazilian´s new system of binding precedents, formally introduced by the 2015 Code of Civil Procedure, considering concepts and theories of the economic analysis of law, with special emphasis on the study of private incentives for litigation and their relationship with the lack of predictability in the application of law by Brazilian Courts.
